Please read these terms and conditions carefully as they affect your rights and liabilities under the law.
We reserve the right to review and amend these conditions from time to time.
If you are a customer there are certain terms implied under your statutory rights, which we cannot exclude, or limit. It is important for you to know that nothing in our terms and conditions affects your statutory rights. Account creation
You must be at least 18 years of age (or a business operated by someone at least 18 years of age) to open an account with us.
You must ensure that the details you provide are complete and accurate, including your delivery instructions. Any change to your details must be notified to us promptly, either by updating your details via your account on the website or by calling Mr Emment’s Emporium on 07734 886551.
You will be asked to create a password as part of the online account creation process.
Your password must be kept confidential and you will be responsible for all activities that occur and all that are submitted under its use.
You must notify us immediately if you know or suspect that someone knows your password and recommend that it is changed immediately via the ‘log into your account’ section of our website.
You will receive an email notification from us of your account set-up, please keep this email for your records.
The details you provide are governed by our privacy policy which is available here.
Your account is not a credit account and payment will be required when your order is processed.

Payment
We cannot accept any liability for how long it takes the banks to process your payment, either by card or by cheque.
We reserve the right to refuse deliveries to you and to cancel your account where payment(s) have been withheld. You agree to compensate us in full for all reasonable costs and expenses (including legal costs) in obtaining payments that have not been made in accordance with these terms and conditions.
Ordering and purchasing
Orders placed with us may be subject to acceptance based upon a minimum spend, which are published on our website. We reserve the right to alter the existing, or introduce new minimum spend conditions which will be published on this website.
Any orders you make on the website will be automatically submitted to us at the order cut off times published on our website
You have the ability to alter, amend and cancel your order up until this cut off time and by allowing an order to be submitted to us you confirm that you have made any such corrections and cancellations and enter into a contract to buy the products from us.
Where the removal of a product reduces your spend in a particular product category below a given minimum spend threshold then we reserve the right not to deliver all products within that product category. Where the minimum order value is not met we reserve the right not to deliver your entire order.
No order placed online is accepted from us until our website displays an order confirmation message. You will receive an order email and this email should be kept for reference until your order has been delivered and accepted as correct.
While we will endeavour to deliver all accepted orders, our products are subject to availability and we do not always know if a product is, or will be available for delivery at the time of accepting an order. If we are unable to deliver an item you have ordered we may offer a reasonable substitute. We will bear no liability for the unavailability of our products.
All of the produce that we offer are subject to variations in seasonal availability and supply price.
All prices displayed on the website are inclusive of any applicable taxes and duty (including VAT where applicable).
Delivery and delivery instructions
We have a flat fee delivery charge of £1.95 on all orders.
We will deliver to the address you stated in your order.
We reserve the right not to deliver to all locations, or not to deliver all products to all locations. You will be notified during the account creation process if we are unable to deliver to your address. Where we are unable to deliver certain products to your address we will make them unavailable for you to order.
It is your responsibility to make suitable arrangements to receive your delivery. The delivery details section of your account is important as it allows you to leave instructions of a suitable location where your delivery can be left if you are not at home to take receipt of the goods, which forms part of our contract under these terms and conditions. It is important that you provide a suitable means (at your own cost) to keep any goods we deliver that need to be refrigerated at a temperature below 8C (degrees centigrade) until such a time as you are able to refrigerate them.
Once your delivery instructions have been followed and completed by us, you will accept that you are in possession of the delivered goods. Where the delivery instructions have been followed; we will not accept any liability for damage to, or theft of your goods, nor will we accept any liability for any incidents, which may arise as a result of the theft or damage to such goods. We will take a photo of any boxes left to prove delivery has been made.
In order to maximise efficiency and reduce food miles your order will be delivered on a set day of the week. We will aim to keep this day fixed, however, we reserve the right to change it and we will notify you of any such changes.
The timing of when your order is delivered on that day will vary week on week depending on traffic, weather and the number of deliveries to be made that day. If ordering regularly, you may notice that your delivery occurs at a similar time each week, however, we make no guarantee of this time and accept no liability for inconvenience or loss as a result of a deviation from it.
We cannot accept liability for any inconvenience or loss where we are unable to deliver to you, or deliver to you late for reasons beyond our control.
We will of course refund you for any part of your order, which is not delivered, or which has been compromised as a result of the delay, we would endeavour to get it to you the next day.
To minimise our carbon footprint we do not to provide a printed receipt with your delivery.
You must inspect your goods as swiftly as possible after delivery and notify us promptly of any errors.
Cancellation
You can cancel your order either online or by phone or email. Cancellations made online by 10pm, or by 5pm by phone or email, two days before your delivery are free. In exceptional circumstances and at our discretion, we can cancel orders until 1pm the day before your delivery.
Warranties & applicable law
We guarantee that our products will be of a satisfactory condition and quality (with the exception of defects caused by your mis-use, neglect or by accidents while the goods were in your possession). Please notify us if you are dissatisfied with any of our products. If upon examination they are defective or faulty we will gladly replace them.
Our entire liability under these terms and conditions will not exceed the purchase price of the goods in question.
We shall not be liable for any delay or failure in the performance of our obligations due to events beyond our reasonable control such as but not limited to fire, adverse weather, acts of God, strikes, labour disputes, civil unrest, accident, disruption to energy supplies, equipment or supplier failure, road traffic problems, terrorism or war.
These terms and conditions are governed by and construed in accordance with British law and the British courts will have no-exclusive jurisdiction over any disputes, which arise in relation to these terms and conditions.
Payments Provider – Stripe
Mr Emment’s Emporium uses the 3rd party payment platform, Stripe, the Stripe API, and in conjunction, your Stripe account to process credit and debit card transactions.
By using the Stripe Check Out you agree to be bound by Stripe’s Terms of Service.
You expressly understand and agree that Mr Emment’s Emporium shall not be liable for any payments and monetary transactions that occur through your use of the Service. You expressly understand and agree that all payments and monetary transactions are handled by Stripe. You agree that Mr Emment’s Emporium shall not be liable for any issues regarding financial and monetary transactions between you and any other party, including Stripe.
You are responsible for all transactions (one-time, recurring, and refunds) processed through the Service and/or Stripe. Mr Emment’s Emporiums is not liable for loss or damage from errant or invalid transactions processed with Your Stripe account. This includes transactions that were not processed due to a network communication error, or any other reason. If You process a transaction, it is Your responsibility to verify that the transaction was successfully processed.
You understand that Mr Emment’s Emporium uses the Stripe API to run the Service and that the Stripe API is subject to change at any time and such changes may adversely affect the Service. You understand and agree to not hold Mr Emment’s Emporium liable for any adverse affects that actions (whether intentional or unintentional) on the part of Stripe may cause to Your Stripe account, or Your business.
You must not process stolen credit cards, or unauthorized credit cards through Stripe.
Transaction security
All transaction information passed between Mr Emment’s Emporium and Stripe’s systems is encrypted using 256-bit SSL certificates. No cardholder information is ever passed unencrypted. You can be completely assured that nothing we pass to Stripe’s servers can be examined, used or modified by any third parties attempting to gain access to sensitive information.
Privacy Policy
Your personal information
When you order we ask for your name, physical address, email and a phone number. We require your name and address in order to process and deliver your order. If we need to contact you about your order we may phone or email you.
How we use your information
We use the personal information you provide to us to supply our services to you. These include, processing your payment and delivering your order. We never pass on your information unless require to by law.
If you sign up to our offers newsletter, we collect your email address in MailChimp and will use it to send you email information on our products and offers. You can unsubscribe from those emails at any time by using the unsubscribe link that is at the bottom of the email.
Our contact form
Any information given via our contact us form will be stored on the website for a maximum of 6 years. The information will be used to answer any question or query only. This information is also sent via an automated email to info@mremments.co.ukand will be stored on the email server for a maximum of 6 years and locally on computers owned by the employees of Mr Emments. At any time, you can contact us by email to request we delete all the information we have on you or request for us to let you know what information we have.
We do not ask for sensitive personal information.
Offer or newsletter signup
We have a newsletter signup on our home page. If you signup for this service, you may receive emails with offers, discounts or information about our company. We may also use this service to do research on our customer preferences via surveys.
You have the right to unsubscribe from the newsletter at any point by using the unsubscribe link on the email or by contacting us and asking to be removed.
Disclosure of your personal data
Where applicable if required we may have to provide your information to law enforcement agencies.
Information access
Access to your information is restricted to employees of Mr Emment’s.
Our website hosting and maintenance service is provided by Sapphire Blue Web Design. Your data may be accessed by employees of that company if required to troubleshoot or deal with any website problems or ordering issues.
Disclaimer
Though we try very hard to protect your data, the internet is not perfect and we cannot guarantee the security of any personal data that travels over the internet. It is your responsibility to keep yourself safe online as far as possible.
